1. Introduction
These Terms and Conditions ("Agreement") govern all construction, remodeling, renovation, and related services ("Services") provided by Benton Builders ("Contractor") to the client ("Client"). By hiring Benton Builders, the Client agrees to be bound by this Agreement.
2. Scope of Work
2.1 Contractor shall perform the Services described in the written estimate, proposal, or contract provided to the Client.
2.2 Any changes to the scope of work must be agreed upon in writing through a Change Order, which may affect pricing and project timelines.
3. Estimates and Pricing
3.1 All estimates are valid for 30 days unless otherwise stated.
3.2 Estimates are based on the information available at the time. Hidden conditions or unforeseen issues may result in additional charges.
3.3 Pricing may include labor, materials, subcontractor fees, permits, and other related costs unless otherwise noted.
4. Payments
4.1 Payment schedules will be outlined in the contract or estimate.
4.2 Deposits are required to secure scheduling and purchase materials.
4.3 Client agrees to pay all invoices within the timeframe stated in the contract. Late payments may incur interest or project delays.
4.4 Failure to pay may result in suspension of work or termination of the contract.
5. Permits and Approvals
5.1 Contractor will obtain necessary permits unless otherwise agreed in writing.
5.2 Client is responsible for HOA approvals or any restrictions specific to their property.
5.3 Delays caused by agencies, inspections, or external reviewing entities are not the responsibility of the Contractor.
6. Project Timeline
6.1 Timeframes provided are estimates. Construction timelines may be affected by weather, material availability, subcontractor scheduling, discovery of hidden conditions, or changes requested by the Client.
6.2 Contractor is not liable for delays beyond their reasonable control.
7. Access to Property
7.1 Client agrees to provide Contractor and subcontractors full access to the property during agreed-upon working hours.
7.2 Client must ensure areas are cleared and safe for work to begin.
7.3 Any delays caused by lack of access may incur additional charges.
8. Materials and Warranties
8.1 Contractor may use subcontractors and approved suppliers.
8.2 Manufacturer warranties apply to materials where applicable.
8.3 Contractor provides a workmanship warranty (term to be specified in the contract).
8.4 Warranty is void if third parties modify or alter the completed work.
9. Change Orders
9.1 Any request for extra work, modifications, or additions must be approved in writing.
9.2 Change Orders may include revised pricing and timeline adjustments.
10. Site Conditions and Hidden Issues
10.1 Contractor is not responsible for pre-existing issues such as mold, rot, faulty electrical, plumbing issues, asbestos, or structural defects.
10.2 If discovered, Contractor will notify the Client and provide additional cost estimates for remediation.
11. Liability and Insurance
11.1 Contractor maintains appropriate licensing and insurance according to California state requirements.
11.2 Contractor is not liable for damage caused by pre-existing conditions, third parties, or events beyond Contractor’s control.
11.3 Client is responsible for securing or removing personal items from the work area.
12. Termination
12.1 Either party may terminate the Agreement with written notice if the other party materially breaches its obligations.
12.2 The Client agrees to pay for all work completed, materials purchased, and costs incurred up to the date of termination.
13. Dispute Resolution
13.1 Any disputes shall first be addressed through good‑faith negotiation.
13.2 If unresolved, the parties agree to mediation in Los Angeles County before pursuing litigation.
13.3 California law governs this Agreement.
14. Photography and Marketing
14.1 Unless otherwise agreed in writing, Contractor may photograph completed work for portfolio and marketing purposes.
14.2 No personal client information will be shared.
15. Acceptance
By hiring Benton Builders or signing a project contract or estimate, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
